General Terms and Conditions

  • Content on the BIGSOUND website and the videos shared as part of the BIGSOUND Conference and The BIGSOUND50 are property of the owner and are not to be downloaded or edited in any way without permission of the copyright holder.
  • Unauthorised downloading and use of any images, logos, audio or video from the BIGSOUND website or Delegate Portal is strictly prohibited.
  • If you have registered to be part of the Delegate Directory, your name, organisation and website details can be viewed online in the Delegate Portal by other delegates. If permission is given at time of registration, your email address will also be visible. 
  • To register as a member you must quote your membership number. If you do not know your member number please contact the participating organisation before registering.
  • If you are not a current QMusic member and would like to join QMusic before registering, please see HERE
  • Delegate passes are not transferrable.
  • All BIGSOUND virtual events are recommended to audiences 18 years and older.
  • Inappropriate behaviour such as verbal abuse, derogatory or discriminatory language or behaviour or any type of harassment, racism and sexism will not be tolerated at BIGSOUND. If you are banned from an official event because of inappropriate / disruptive behaviour, BIGSOUND reserves the right to revoke your delegate pass without notice.
  • BIGSOUND 2020 is recommended for people aged 18 years and older. Some of the sessions may contain course language and adult themes. All information in these videos are for general knowledge and entertainment purposes only. Accordingly, the information on bigsound.org.au is provided with the understanding that the presenters are not herein engaged in rendering legal, accounting, tax, or other professional advice and services. As such, it should not be used as a substitute for consultation with professional accounting, tax, legal or other competent advisers.

BIGSOUND Digital Safety Conditions

This Digital Safety Agreement is between you, the participant of BIGSOUND, and QMusic, the Producer of BIGSOUND.

QMusic is committed to ensuring a safe digital environment, providing an inclusive and transformational experience during BIGSOUND. By submitting your Delegate Profile, you are agreeing to uphold the following standards and expectations of behaviour when using the BIGSOUND website and networking through BIGSOUND. 

All BIGSOUND attendees have a right to a safe and inclusive experience and any individual found not upholding these standards will be removed from the platform. 

  1. Be Kind and Courteous. We're all in this together to create a welcoming environment. Let's treat everyone with respect. Healthy debates are natural, but kindness is required.

  2. No Hate Speech or Bullying. Make sure everyone feels safe. Bullying of any kind is prohibited, including potentially degrading or offensive comments about race, religion, culture, sexual orientation, gender or identity.

  3. Respect Everyone's Privacy. Connecting with other delegates requires mutual trust and contacts gained through the delegate portal are to remain private to the two individuals involved.

We encourage anyone who is the subject of inappropriate behaviour that makes them feel unsafe or excluded to notify a BIGSOUND staff member at info@qmusic.com.au, or if of an extreme nature, to report it to the police. 

You will be removed from the BIGSOUND delegate portal if you undertake any of the following activities:

  • Data scraping of the delegate portal. 
  • Inappropriate behaviour of any kind determined at the discretion of the staff of QMusic, who will be monitoring the live feed and chat functionality throughout the event.
  • Bullying or disrespecting others.
  • Sharing another person's details with other delegates without that person’s permission.
  • Consistently using the chat streams or any other digital aspect from the BIGSOUND delegates portal outside their general topics or purpose. 

Inappropriate behaviour will be determined at the discretion of the BIGSOUND team, and their decision is final. The BIGSOUND team will be monitoring every chat platform aligned to the BIGSOUND website and event, and all off-platform Q&As organised by BIGSOUND will also have a BIGSOUND representative monitoring. 

Digital Delivery of BIGSOUND

BIGSOUND will endeavour to deliver a reliable connection and continuous stream for BIGSOUND 2020, but cannot guarantee technical issues will not occur, or that delegates will not experience issues with their own connections. BIGSOUND Refund Policy

Delegate passes for the 2020 event are FREE and therefore no refunds are necessary. For any delegates who purchased a ticket before the event moved to virtual will receive a full refund of their ticket. Proof of purchase may be required for any refund or exchange. Unless required by law (including the Australian Consumer Law), BIGSOUND will not be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

#Terms and Conditions

Obtaining a FREE delegate pass to BIGSOUND and being admitted into a BIGSOUND event is subject to these Terms and Conditions.

Definitions

(a) “BIGSOUND” means the BIGSOUND 2020 Festival which encompasses all events, conference, workshops, artist showcases, concerts and parties organised, staged and conducted by the Organiser between Wednesday 21 October and Thursday 22 October. 

(b) “Event(s)” means any event that is part of BIGSOUND. 

(c) “Organiser” means Queensland Music Network Incorporated ABN 14 083 014 720. 

(d) “Patron(s)” means a Ticketholder who is in attendance at an Event. 

(e) “Ticketholder(s)” means the person who holds a virtual delegate pass. 

(f) “Venue(s)” means the virtual platform or stream of an Event. 

(g) “Venue Operator” means the owner, tenant or person, business or corporation that otherwise has exclusive possession of the Event Venue.

Conditions of entry

1. Entry to an Event:

a) advertised as 18 + event; 

2. Ticketholders acknowledge that:

a) the Organiser reserves the right to refuse or deny digital entry or remove or evict from an Event where the Organiser has reasonable grounds to do so, including if you breach these Terms and Conditions, not abide by rules set out in the platform policy, or adversely affecting the enjoyment of the Event by others.

3. Ticketholders are not permitted to record any Event or screen (audio or video) for commercial or uploading purposes without prior written approval from the Organiser. 

4. Inappropriate behaviour such as verbal abuse, derogatory or discriminatory language or behaviour or any type of harassment, racism and sexism will not be tolerated at BIGSOUND. If you are banned from the digital platform because of inappropriate or disruptive behaviour, BIGSOUND reserves the right to revoke your delegate pass without notice.

6. Protest and political paraphernalia comments are not permitted in the platform live chat. The Organiser reserves the right to remove any comment or person deemed by the Organiser to be racist, vilifying, sexist and/or offensive. 

Risk 

9. Entry to the Platform is at the Ticketholder’s own risk.

10. The Ticketholder acknowledges that offensive language may be used by some performers and artists.

11. The Ticketholder acknowledges and agrees that the Organiser (and its employees, contractors and agents) shall not be liable for any loss, cost, expense, injury, claim or damages suffered or sustained by any Ticketholder. The Ticketholder acknowledges and agrees that the Organiser limits its liability in respect of breach of any statutory guarantee under the Australian Consumer Law (ACL) in the manner set out in sections 64A(1)(a) and 64A(2)(a) of the ACL. 

12. To the full extent permitted by law, Ticketholders waive all legal rights of action against and fully release the Organiser, its agents, employees and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the Ticketholder’s entry to and presence at any Venue and their attendance at any Event and their involvement in BIGSOUND.

Delegate Members

13. Your name, organisation and website details can be viewed online in the Delegate Portal by other Ticketholders. If permission is given at time of registration, your email address will also be visible.

14. To register as a member you must quote your membership number. If you do not know your member number please contact the participating organisation before registering.

Privacy

16. It is a condition of purchase that the Ticketholder consents to the Organiser collecting and retaining their personal information. The Organiser will hold your information as required by the Privacy Act 1988 (Cth) and for contacting you in relation to ticketing matters and Event information. The Organiser will not trade or sell your personal information but may use it for future events of the Organiser. 

Authenticity and validity of tickets

17. Entry to an Event may be refused if the authenticity or validity of a ticket is questionable or has not been registered properly from the Organiser or other authorised points of sale.

Variations to performances or events

18. The Organiser reserves the right to vary the BIGSOUND program and/or to add, withdraw or substitute presenters, conference speakers and artists. No compensation will be made in such circumstances, or if the BIGSOUND or Event program varies due to the non-appearance of an advertised presenter, conference speaker or artist.

Refunds, exchanges and replacements

21. BIGSOUND delegate passes are not transferrable. 

22. If BIGSOUND is cancelled, rescheduled or significantly relocated by the Organiser (physically or virtually) proof of purchase may be required for any refund or exchange. Unless required by law (including the Australian Consumer Law), the Organiser will not be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

23. Ticket holders acknowledge that there may be restricted capacities at some of the Events, and having a delegate pass does not guarantee entry to these areas in such circumstances. Once it is determined by the Organiser or the Venue Operator (at their sole discretion) that the maximum capacity has been reached in these areas, there will be no further admissions.

Severance

24. Any provision of these Terms and Conditions which are or becomes unenforceable shall not invalidate the other provisions of these Terms and Conditions.

Interpretation

25. Unless the context otherwise requires a word which denotes: 

a) the singular includes the plural and vice versa; 

b) any gender includes the other genders; and 

c) a person includes an individual, a body corporate and a government. 

45. Unless the context otherwise requires a reference to:

a) any legislation includes any regulation or instrument made under it and where amended, re-enacted or replaced means that amended, re-enacted or replacement legislation; 

b) any other agreement or instrument where amended or replaced means that agreement or instrument as amended or replaced; 

c) a clause, schedule, annexure or exhibit is a reference to a clause of, annexure to, schedule to or exhibit to this agreement; 

d) a group of persons includes any one or more of them; 

e) any thing or amount is a reference to the whole and each part of it; and 

f) "$" or “dollars” are the lawful currency of Australia.
